This agreement describes the procedures and steps that TrueBuki takes in response to notifications of alleged copyright infringement in accordance with section 512(c) of the United States Copyright Act for the digital age (DMCA).
Notification of Infringement If you are the owner of copyright or are authorized to act on behalf of one, and you believe that the work, protected by copyright, has been copied and is available on TrueBuki in a way that constitutes copyright infringement, you can submit a written notice containing the following information:
- The physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Description of the copyrighted work that has been subjected to alleged infringement, and identification of the material that is the subject of infringement.
- Enough information for TrueBuki to be able to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that the notifying party in good faith believes that the use of the material in the disputed manner is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that the notifying party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
TrueBuki's Response Upon receiving a properly formatted notice of infringement, TrueBuki will take actions to remove or disable access to the material that allegedly infringes the copyright, and will take reasonable steps to notify the user who uploaded the material, that the material has been removed or access to it has been disabled.
Objection to Material Removal If the user who uploaded the material believes that the removal was incorrect, the user can submit a counter-notice containing the following:
- The physical or electronic signature of the user.
- Description of the material that was removed, and the location of the material prior to its removal.
- A statement under penalty of perjury that the user in good faith believes that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- The user's name, address, telephone number, and a statement that the user agrees to the jurisdiction of the federal court for the judicial district in which the user's address is located, or if the user's address is outside the United States, for any judicial district in which TrueBuki may be found, and that the user will accept service of process from the person who provided the copyright infringement notice.
After receiving a counter-notice, TrueBuki may restore the material in 10-14 business days if no notice is received from the copyright owner of filing a lawsuit to prevent further infringement of the material.
